Terms of Service
What this is
The viewer is a private tool operated by ACR Technical Group Inc. (“ACR Tech”) for clients to view survey data we have captured for them. Access is by invitation. These terms sit alongside whatever survey agreement your company already has with us; where the two disagree, that agreement wins.
Your account
Your account is your email address, and it is yours alone. Do not let anyone else sign in as you, and do not forward a sign-in link or code to anyone — either hands them your access. Tell us promptly if you think someone else has got into your account.
If you are given the ability to invite people or change roles, you are responsible for who you let in and what you let them do.
Share links
A share link grants whoever holds it access to one capture, without any sign-in. Treat one as you would the file itself: anyone you send it to can pass it on. Only Owners and Admins can create them.
Acceptable use
Do not:
- attempt to reach data belonging to a company you are not a member of;
- probe, scan or attempt to bypass the sign-in or permission system;
- extract data at scale by automated means, or use it to build a competing service;
- upload anything unlawful, or anything you have no right to upload.
If you find a security flaw, please tell us at awall@acrtech.ca rather than demonstrating it on someone else's data. We will not pursue anyone who reports a genuine flaw in good faith and gives us a reasonable chance to fix it.
Who owns what
Survey data belongs to the client it was captured for, on the terms of that client's agreement with us. The viewer software, its design and its documentation remain ours. Measurements, marked points and sections you create are yours; you grant us only the permission needed to store them and show them back to you.
Accuracy
Measurements taken in the viewer are derived from survey data and are subject to the accuracy stated in the deliverable that data came from. On-screen measurement is a convenience, not a certified survey product. Do not rely on it for construction layout, legal boundaries, volumetric payment or anything else consequential without checking it against the signed deliverable, or asking us.
Availability
We aim to keep the viewer running but do not promise it will always be available. It may be down for maintenance, or because of a fault at a provider we depend on. It is a way to view your data, not the place your data is kept safe — ACR Tech holds the authoritative copy of every deliverable.
Ending access
We may suspend or remove an account that breaches these terms, and we will remove access when a client relationship ends. Your company's Owners and Admins may remove your access at any time. You can stop using the viewer whenever you like; ask us and we will delete your account.
Liability
The viewer is provided as is. To the extent the law allows, ACR Tech is not liable for indirect or consequential loss arising from its use, and our total liability relating to the viewer is limited to the amount your company paid us for the survey work the data came from. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there.
Changes
We may update these terms; the date at the top will change, and account holders will be told by email about material changes.
